A. Offer Details
1. Who is eligible for the Offer?
The Offer is strictly limited to Eligible Customers.
2. When is the Offer available?
The Offer is only available during the Offer Period, unless otherwise varied by us.
3. Can the Offer be varied or discontinued?
We can vary, extend, amend or discontinue the Offer at any time. We will still honour the Offer for the Subscription Period if you’ve accepted the Offer prior to it being discontinued.
4. How do you accept the Offer?
To accept the Offer, you must, during the Offer Period, subscribe to an Eligible Product Subscription online via the Offer landing page (https://www.myob.com/nz/comms/business/anz-business). If you are an Eligible Customer, by accepting the Offer you are automatically eligible for the Offer and are deemed to have accepted these Offer Terms.
5. What’s included in the Offer?
5.1 Under the Offer, you must pay for the 1st month of a MYOB Business Lite or MYOB Business Pro base subscription (Eligible Product Subscription), during which time you can also access and use the additional Payroll Premium Feature in your Eligible Product Subscription for free.
5.2 After paying for the first month’s subscription for your Eligible Product Subscription, which will be prorated to the day you subscribed for an Eligible Product Subscription, you will receive a 100% discount on the standard monthly base subscription price for one Eligible Product Subscription for the balance of the Subscription Period, which has a maximum total period of further 12 months.
For the avoidance of doubt, you must pay for the first month’s Eligible Product Subscription, during which time you receive access to the Payroll Premium Feature for free. From month 2 to month 13 you receive only the Eligible Product Subscription for free and will have to pay for any use of the Payroll Premium Feature (in addition to any other offer exclusions identified in clause 6).
5.3 The Offer only applies to the cost of the particular Eligible Product Subscription selected at the time of accepting the Offer. This offer will continue to apply if you change the MYOB product you subscribe to within the Subscription Period, to another Eligible Product Subscription, provided that you are still an MYOB Customer.
For example: if you first subscribe to MYOB Business Lite when accepting this Offer, and within the second month of your Subscription Period you elect to upgrade to MYOB Business Pro, the Offer will apply to your MYOB Business Pro subscription for the remainder of the Subscription Period. After the Subscription Period has ended, the cost of the Eligible Product Subscription will revert to RRP. For up to date information on pricing, see www.myob.com/nz
6. What’s not included in the Offer?
6.1 The Offer only applies to the standard no-charge inclusions associated with an Eligible Product Subscription and does not apply to MYOB Business Payroll Only, Premium Features, or excess transaction charges payable under the MYOB Bank Feeds Fair Use Policy.
6.2 By accepting this Offer, you agree to pay any additional fees or charges incurred for Premium Features that are not the standard no-charge inclusions, during the Subscription Period. For up-to-date information on pricing see www.myob.com/nz.
1. What happens at the end of the Subscription Period? At the end of the Subscription Period, the cost of your Eligible Product Subscription will automatically revert to the then-standard RRP.
B. ANZ Disclaimer
1. ANZ does not guarantee the quality of MYOB software or its suitability for Your circumstances.
2. To the extent the law allows, ANZ doesn’t accept any responsibility for loss or damage (including indirect or consequential loss) suffered as a result of Your use of an Eligible Product Subscription, or this Offer, unless such losses relate to ANZ’s fraud, negligence or willful default.
1. We reserve the right to rescind any discounts provided to you under the Offer if:
1.2 in our reasonable, opinion you are trying to obtain benefits from the Offer that you’re not reasonably entitled to.
2. You acknowledge that clause C.1.b includes, but is not limited to, Us identifying that you are not an Eligible Customer.
2.1 The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.
In these terms and conditions:
ANZ means ANZ Bank New Zealand Limited.
Eligible Customers means ANZ customers that:
are current ANZ customers on the date they subscribe to an Eligible Product Subscription; and
are not currently, or have not previously been, a MYOB Customer.
Eligible Product Subscription has the meaning given to it in clause 5(a) of these Offer Terms.
MYOB Customer means a user of any MYOB product, including but not limited to MYOB Essentials, MYOB AccountRight, MYOB Business, MYOB AccountEdge, MYOB businesSUPPORT, MYOB BankLink, MYOB Ace Payroll, MYOB IMS Payroll and Enterprise Solutions ERP.
Offer means the ANZ customer exclusive offer, which is offered to you under these Offer Terms.
Offer Period commences at 9am NZST on 5 October 2022, and runs to 5pm (NZST) on 1 July 2024, unless otherwise varied in accordance with these Offer Terms.
Offer Terms means these terms and conditions.
Payroll Premium Feature means the Payroll Premium Feature offered by MYOB from time to time. Premium Features are optional features accessible from an MYOB Business Lite or MYOB Business Pro base subscription and are charged on a pay-per-use basis (except as otherwise stated in this Offer). Read this Help Article for more information of the standard Payroll Premium Feature limits and usage charges.
Subscription Period means the period between the date you first subscribe to an Eligible Product Subscription under the Offer, until the end of the discounted period (which is a maximum total of 13 months, including the first month which the customer must pay for).
You, your, yours means the ANZ customer that is accepting the Offer and subscribing to an Eligible Product Subscription.
We, us, our means MYOB NZ Limited.
$ means NZ$.
