A. KEY DETAILS
Eligible Customers | Means a member of the MYOB Partner Program based in the Territory (including Partner, Certified Consultant, Bookkeeper, POS or Connected Account Programs and customers who have commenced their application to become an MYOB Partner Program member). |
Eligible Products | “MYOB Business Lite”, “MYOB Business Pro”, “MYOB Business AccountRight Plus”, “MYOB Business AccountRight Premier”, “MYOB Business Connected Ledger” or “MYOB Business Connected Ledger + Payroll”. |
Offer | Make 10 or more Successful Referrals during the Promotion Period and receive 100 bonus referral points. For the avoidance of doubt, you will still receive any ordinary referral points in addition to these bonus points. |
Promotion Period | from 1 March 2024 until 5pm 31 March 2023. |
Successful Referral | means the act of referring a customer to MYOB and that customer subscribes to an Eligible Product on a ‘partner pays’ or ‘client pays’ payment model. |
B. OFFER CONDITIONS
Who is eligible for the Offer? The Offer is strictly limited to Eligible Customers.
When is the Offer available? The Offer is available during the Promotion Period, unless otherwise varied by us. All references to time in these Terms are a reference to the local time in the capital city of the applicable Territory, on the date stated.
How do you accept the Offer? By redeeming this Offer, you agree that you have read and understood these Terms and agree to be bound by them. To redeem the offer you must, during the Promotion Period make a Successful Referral. Successful Referrals can be made by speaking with an MYOB sales agent and referencing the Offer or purchasing an Eligible Product subscription for a Referred customer via the Partner Dashboard.
What’s included in the Offer? You will receive 100 bonus referral points for making at least 10 Successful Referrals during the Promotion Period. This is on top of any ordinary referral points that you are entitled to for each successful referral. For example, you may be entitled to 60 points for 10 successful referrals, meaning that during the Promotion Period, you will be entitled to receive 160 points.
How to claim your bonus points? You don't need to do anything to claim your bonus points. They will be automatically added to your account by 17 May 2024. You can check your referral points balance in Partner Hub.
What are other conditions of the Offer?
The Offer cannot be applied retroactively for prior purchases.
The Offer is not available in conjunction with any other offer and is not transferable.
You can use the best offer available to you at a single point in time, but not a combination of offers at any point in time.
This Offer is available “one time only” during the Offer Period, meaning that the Offer can only be applied to a single Eligible Product subscription of the Partner’s, who is redeeming this Offer.
Your use of the Eligible Product remains subject to the Eligible Product’s Terms of Use.
If you accepted this Offer on an unsolicited sales call, this Offer is subject to a 10-day cooling-off period. If within the first 10-days of accepting this Offer you wish to terminate this agreement, you can do so without incurring a penalty. If you terminate within the 10-day cooling off period, you acknowledge and agree that any monies paid by any party under this Offer will be immediately refundable.
C. GENERAL CONDITIONS
MYOB Rights. Without limiting other remedies and in addition to rights under the Eligible Product’s Terms of Use we reserve the right to rescind any discounts provided to you under the Offer if:
you don’t comply with the Eligible Product’s Terms of Use, MYOB Partner Program terms or terms of use for other related MYOB products; or
in our opinion you are trying to obtain benefits from the Offer that you are not reasonably entitled to.
Your Rights. The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.
Privacy and Data Use. We may collect and use information about you to administer the Offer. Your personal information will otherwise be used in accordance with our Privacy Collection Notice and Group Privacy Policy which contains more information on how we collect, use and disclose your personal information.
Liability. To the extent permitted by law, MYOB will not be responsible for any loss incurred by you in redeeming or attempting to redeem the Offer or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Offer.
Changes. The Terms may be subject to change. We reserve the right to vary or withdraw the Offer at any time by providing you with notice. Notice will be affected in accordance with the notice requirements contained in the Eligible Product’s Terms of Use. We will honour the Offer if you have accepted the Offer prior to its withdrawal or variation.
Governing Law. These Terms are governed and construed in accordance with the laws in force in the State of Victoria, Australia (if you accept these Terms in Australia), and the laws in force in New Zealand (if you accept these Terms in New Zealand).
Definitions. Unless the context otherwise requires, in these Terms:
Eligible Customers, Eligible Products, Offer, Promotion Period and Successful Referral each have the meaning given to them in the key details section.
MYOB, we, us, our means: MYOB Australia Pty Ltd (ABN 13 086 760 198) if you accept these Terms in Australia; or MYOB NZ Limited (NZCN 902338) if you accept these Offer Terms in New Zealand.
MYOB Business Product means MYOB Business Connected Ledger, MYOB Business Connected Ledger + Payroll, MYOB Business Lite, MYOB Business Pro, MYOB Business AccountRight Plus, MYOB Business AccountRight Premier.
Offer means this exclusive offer, which is offered to you by us under the Terms.
Terms means these terms and conditions.
Territory means Australia (if you accept these Terms in Australia) or New Zealand (if you accept these Terms in New Zealand).
You and your refers to the customer that is accepting this Offer under section 3; and is an Eligible Customer.
For more information on Partner Program membership see here) that is redeeming this Offer in accordance with the requirements in section 3 of these Terms.
