MYOB Desktop File Offer: $10 for MYOB Business (CAP / BK Program Members Only) – Terms and Conditions

A. KEY DETAILS

Eligible Customer

select members of the Connected Accountant/BK Program (Program) who, in taking up this offer, are terminating their Program membership and are migrating any desktop company data files under that Program, to an Eligible Product Subscription.

Eligible Product Subscription

means a base subscription to “MYOB Business Connected Ledger”, “MYOB Business Connected Ledger + Payroll”, “MYOB Business Lite”, “MYOB Business Pro” or “MYOB Business AccountRight Plus”. “Base subscription” excludes Premium Features such as Payroll and Premium Inventory.

Discount

$10 per month for each Eligible Product Subscription subscribed to under this Offer (subject to the conditions and limitations outlined within these Terms).

Discount Period

the period between the date that you redeem this offer until 11.59pm on 30 June 2027.

Offer Period

The period between 26 February 2024 until 5pm (AEST) 30 June 2024, unless otherwise varied by us.

B. OFFER DETAILS

Who is eligible for the Offer? The Offer is strictly limited to Eligible Customers.

When is the Offer available? The Offer is only available during the Offer Period, unless otherwise varied by us. We reserve the right to vary or discontinue the Offer at any time. We will still honour the Offer if you’ve accepted prior to it being discontinued.

How do you accept the Terms and redeem the Offer? To redeem the Offer, you need to do the following:

  • Buy an Eligible Product subscription from an MYOB sales agent during the Offer Period and mention the Offer.

  • Give the sales agent any relevant information they ask for (such as Serial Number and list of Company File Names).

  • Read and accept these Terms either verbally or in writing before you complete your subscription purchase.

By redeeming the Offer, you agree to follow these Terms.

What’s included in the Offer? The Offer grants you access to an Eligible Product Subscription for $10 per calendar month, for the Discount Period (subject to clause 8).

What’s not included in the Offer? The Offer does not include anything that falls outside the standard no-charge inclusions associated with MYOB Business. For example, the Offer does not cover Payroll fees or online invoice payment fees. By accepting this Offer, you agree to pay any additional fees or charges during your discounted subscription period.

What happens at the end of the Discount Period? After the Discount Period, the cost of the Eligible Product Subscription will revert to the MYOB Partner Wholesale price based on the membership tier at that time. For up-to-date information on pricing, see www.myob.com or your Partner Hub Account. By providing us your credit or debit card details and agreeing to our Direct Debit Terms and Conditions, you acknowledge that the subscription automatically renews on a monthly basis and you authorise us to debit your credit or debit card the RRP price at the end of the Discount Period.

Can I upgrade or downgrade within the Discount Period? Yes, you can upgrade or downgrade to any other Eligible Product within the Discount Period, and the Offer will be applied to the base subscription price for that other Eligible Product.

What other conditions apply to the Offer?

  • This Offer can be applied to multiple Eligible Product subscriptions purchased in the same transaction.

  • The Offer cannot be applied retroactively for prior purchases.

  • The Offer is not available in conjunction with any other offer and is not transferable.

  • You can use the best offer available to you at a single point in time, but not a combination of offers at any point in time.

  • Your use of the Eligible Product remains subject to the Eligible Product’s Terms of Use.

  • The Discount is subject to change at any time at MYOB’s discretion. If there is a price increase, we will give you notice in accordance with the Eligible Product’s Terms of Use. If you do not agree to the new price, you can cancel your Eligible Product Subscription before the new price comes into effect.

  • If you accepted this Offer on an unsolicited sales call, this Offer is subject to a 10-day cooling-off period. If within the first 10-days of accepting this Offer you wish to terminate this agreement, you can do so without incurring a penalty. If you terminate within the 10-day cooling off period, any monies paid under this Offer will be refundable.

C. GENERAL CONDITIONS

  1. MYOB Rights. Without limiting other remedies and in addition to rights under the Eligible Product’s Terms of Use or MYOB Partner Program terms we reserve the right to rescind any discounts provided to you under the Offer if:
    a) you don’t comply with the Eligible Product’s Terms of Use, MYOB Partner Program terms or terms of use for other related MYOB products; or
    b) in our opinion you are trying to obtain benefits from the Offer that you are not reasonably entitled to.

  2. Your Rights. The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.

  3. Privacy and Data Use. We may collect and use information about you to administer the Offer. Your personal information will otherwise be used in accordance with the MYOB Group Privacy Policy (New Zealand) which contains more information on how we collect, use and disclose your personal information.

  4. Liability. To the extent permitted by law, MYOB will not be responsible for any loss incurred by you in redeeming or attempting to redeem the Offer or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Offer.

  5. Changes. The Terms may be subject to change. We reserve the right to vary or withdraw the Offer at any time by providing you with notice. Notice will be affected in accordance with the notice requirements contained in the Eligible Product’s Terms of Use. We will honour the Offer if you have accepted the Offer prior to its withdrawal or variation.

  6. Governing Law. These Terms are governed and construed in accordance with the laws in force in New Zealand.

  7. Definitions. In these terms and conditions:

Discount, Discount Period, Eligible Customer, Eligible Product Subscription, and Offer Period each have the meaning given to them in the Key Details section.

We, us, our means MYOB Australia Pty Ltd (ABN 13 086 760 198) (if you accept these Terms in Australia); and MYOB NZ Limited (NZCN 902338) (if you accept these Terms in New Zealand).

Offer means this MYOB Desktop File Offer: $10 for MYOB Business (CAP / BK Program Members Only), which is offered to you under the Terms.

Terms means these terms and conditions.

You, your, yours means the customer that is accepting the Offer.

You, Your and MYOB Customer means a member of the Connected Accountants Program (CAP), Bookkeeper Program (BK) or MYOB Partner Program
