Direct Debit Request Services agreement in Australia.

This section sets out your rights and obligations when undertaking a direct debit arrangement with us, and what our obligations are to you. These terms and conditions are in addition to any terms and conditions that apply to product or services agreement(s) you have in place with us.

1. By agreeing to a direct debit request by the method presented, you authorise MYOB Australia Pty Ltd (ABN 13 086 760 198, APCA User ID 405350) and its financial institution to deduct from your nominated account any fees and/or charges due under product or services agreement(s) you have in place with us (as varied from time to time). You also authorise us to make any other debits permitted under this agreement or your direct debit request.

2. We will arrange for funds to be debited from your nominated account on the relevant invoice due date. If the invoice due date falls on a non-business day or public holiday, the payment may be processed on the next business day.

3. This authority permits us to change the amount debited from your nominated account to reflect changes to prices. We must provide at least 14 days’ notice or such longer period as stated in your existing product or services agreement. It also permits us to change the amount debited or charged to cover any increases in amounts payable arising from the purchase of additional products by you from time to time, with at least 14 days’ notice.

4. We will notify you of any changes to the debit arrangements in writing at least 14 days in advance.

5. We may send you notices by email.

Your responsibilities

6. It is your responsibility to ensure that you have sufficient funds available in your nominated bank account to cover payment and that your bank account details are up-to-date and correct. Changes to your direct debit arrangement must be made by an authorised signatory for the nominated bank account.

7. If we cannot debit payment from the nominated account, we will notify you in writing of the payment default. We may make multiple attempts to debit the full or partial payment for any overdue amount following the repayment due date. We may also seek to enforce our rights under the relevant services agreement and at law, including among other things, suspending the supply of services to you.

8. Direct debiting through the Bulk Electronic Clearing System is not available on all bank accounts. If you are paying by direct debit from your bank account, it is your responsibility to ensure that your bank account can accept direct debits (your financial institution can confirm this). We also advise that you check your bank account details with your financial institution before completing the direct debit request.

9. If you believe that there has been an error in debiting your bank account you should notify us immediately by email at accounts@myob.com. Where applicable, your complaint may be directed by us to your financial institution. Alternatively, you may contact your financial institution direct.

10. We will investigate your complaint and provide you notice of our findings in writing. If we conclude that your bank account has been incorrectly debited, we will advise you and arrange a refund of the amount due to you. On the other hand, if we conclude that your account has been debited correctly, we will advise you and provide evidence of our finding.

11. If you wish to change, suspend, cancel or discuss your direct debit arrangement, contact the MYOB Accounts Department using the email address specified above.

Confidentiality

12. All information provided under this Direct Debit Request Service Agreement to us is confidential. We will make reasonable efforts to keep any such information that we have about you secure and ensure that any of our team members who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information. You acknowledge and agree that we will need to provide information to our financial institution to initiate or alter payment arrangements from your nominated account or to investigate an alleged incorrect or wrongful payment.
