In these terms and conditions:
We, us, our means MYOB Australia Pty Ltd (ABN 13 086 760 198).
Offer means our Partner Pays Exclusive Offer: Desktop files to AccountRight or Essentials – interim discount pricing offer, which is offered to you under the Offer Terms.
Offer Terms means these terms and conditions.
Partner, you, your, yours means the business that is a registered member of our Certified Consultant, Bookkeeper, POS or Connected Accounting Programs.
CDF Discount Offer means our Partner Pays Exclusive Offer - Desktop files to AccountRight or Essentials offer, which you previously accepted.
Discount Period means a period of 12 months commencing on expiry of your existing CDF Discount Offer.
A. Offer Details
1. The Offer is strictly confidential. You must treat the Offer and these Offer Terms as confidential. You must not publicly disclose this Offer or these Offer Terms.
2. The Offer is strictly limited to MYOB Partners who previously accepted our CDF Discount Offer.
3. To accept the Offer, you do not need to do anything. The discounted pricing under this Offer will commence immediately upon your CDF Discount Offer expiring. To opt out of the Offer, you must you must contact an MYOB Partner Manager or Client Manager.
4. The discounted pricing under this Offer only applies to subscriptions for company data files migrated to a new subscription and activated in accordance with your CDF Discount Offer.
5. The Offer gives you:
a. AU$30 per month (including GST) partner-pays pricing for the Discount Period, for each subscription for company data files held and actively used by you or your client before the expiry of your CDF Discount Offer; and
b. the same partner-pays pricing as under your CDF Discount Offer for the Discount Period, for each subscription for company data files held but not actively used by you or your client before the expiry of your CDF Discount Offer.
6. After the Discount Period, the cost of the files will revert to the then-standard pricing for your partner-level status under the MYOB Partner Program.
7. This Offer it not available in conjunction with any other offer, is not transferable and not refundable.
B. General
1. We reserve the right to rescind any discounts provided to you under the Offer if:
a. you don’t comply with our Product Terms of Use or these Offer Terms; or
b. in our opinion you are trying to obtain benefits from the Offer that you’re not reasonably entitled to.
2. We reserve the right to discontinue the Offer at any time. We will still honour the Offer if you’ve accepted prior to it being discontinued.
3. The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.
4. We may collect and use information about you and for the purpose of administering the Offer.
