Telstra Reseller Terms and Conditions
When do these Reseller Terms apply?
These Telstra Reseller Terms and Conditions (“Reseller Terms”) will apply to your use of:
a) MYOB Essentials Accounting Starter; or
b) MYOB Essentials Accounting; or
c) MYOB Essentials Accounting + Payroll
if you have ordered and purchased the Product via the Telstra Apps Marketplace (www.marketplace.telstra.com) operated by Telstra Corporation Limited ABN 33 051 775 556 ("Reseller").
MYOB Australia Pty Ltd (“MYOB” or “our”) will provide your company/organisation (“you” or “your”) with the Product in accordance with these Reseller Terms.
To the extent that there is an inconsistency between the Reseller Terms and the Product Terms, these Reseller Terms prevail.
3. Payment of Fees
You acknowledge that the Reseller is responsible for communicating and dealing with your billing enquiries (including billing disputes) relating to the Product. By purchasing the Product from the Reseller you acknowledge and agree that:
a) fees for the Product will be set between you and the Reseller;
b) fees must be paid directly to the Reseller in accordance with any payment obligations under the Reseller’s agreement with you;
c) the provisions in section 3.8 (Payment of Fees and Direct Debit Authority) of our Product Terms will not apply to your use of the Product; and
d) to request a Product upgrade or downgrade or to change your payment method, you should contact the Reseller. To upgrade to MYOB products not offered in the Telstra Apps Marketplace, you should contact MYOB directly on 1300 793 130.
If you believe there has been an error in debiting your credit card or bank account, you should notify the Reseller immediately at 1800 878 483 so that the Reseller can resolve your query promptly.
4. If your payment is unsuccessful
The Reseller may notify MYOB that you have failed to pay the fees in accordance with your Reseller agreement. If you fail to pay the fees, MYOB may suspend or terminate your use of the Product.

6. Technical and Customer Support Services
MYOB will provide technical and customer support services to you in accordance with the Product Terms. By purchasing the Product from the Reseller you acknowledge and agree that the Reseller may disclose your information, including but not limited to your Personal Information, to MYOB as reasonably required for MYOB to respond to any support issues that you escalate to or via the Reseller.
7. Fees for additional services
We may offer additional services such as MYOB Invoice Payments to complement the Product. Those additional services are subject to additional fees which are payable directly to MYOB.
8. How can you cancel your Subscription?
We’ll be sad to see you go, but you can cancel your Product subscription by notifying the Reseller at least 2 days before the end of the current period of your subscription (Notice). If you do not give Notice to the Reseller in accordance with this section, the termination may not be effective until the following Product subscription period.
9. Governing law
These Reseller Terms are governed by the laws in force in the State of Victoria.
If any of these Reseller Terms are illegal or otherwise unenforceable, they will be severed from the Reseller Terms. All other Reseller Terms will remain in full force where possible.
11. Changes to these Terms
We reserve the right to revise these Reseller Terms from time to time. We’ll give you at least 10 days’ prior notice (longer if required by legislation or any other code of conduct we subscribe to) of any change that is likely to materially affect or disrupt the way you the Product.
