MYOB Advisor Technology Pilot –
Terms and Conditions

The pre-release version of the MYOB Advisor technology ("MYOB Advisor Technology") is provided to your company/practice/organisation ("You" or “Your”) on the following terms and conditions. The MYOB Advisor Technology has not been issued for general release. As part of the development of the MYOB Advisor Technology, MYOB Australia Pty Ltd and MYOB NZ Limited (“MYOB”) are running a pilot to understand the suitability of the MYOB Advisor Technology (“Trial”) for the general market.

If You are in Australia, these terms are between You and MYOB Australia Pty Ltd. If You are in New Zealand, these terms are between You and MYOB NZ Limited.

To participate in the Trial, You must consent to participate on the terms set out below. You understand and agree that:

  1. The MYOB Advisor Technology is a pre-release version which is still undergoing development and may therefore not be error-free, nor perform at optimum performance levels.
  2. The MYOB Advisor Technology is not ready for general release to MYOB clients or to any other person.
  3. As the MYOB Advisor Technology is not a released version, MYOB employees are not fully trained on the MYOB Advisor Technology and may therefore not be in a position to provide support which is usually provided for production versions of MYOB products. MYOB will use its reasonable endeavours to ensure You have priority support for this pre-release version of the MYOB Advisor Technology for the term of the Trial. If You have any queries or problems arising from the use or implementation of the MYOB Advisor Technology, You agree to contact the MYOB pilot support team in the first instance.
  4. Upon MYOB’s request, You must provide feedback on the MYOB Advisor Technology.
  5. Unless authorised by MYOB, You must not divulge features of the MYOB Advisor Technology and the fact that the Trial is being undertaken, except to the extent necessary for You to use the MYOB Advisor Technology in the ordinary course of Your business.
  6. You acknowledge and agree that the purpose of the MYOB Advisor Technology is to provide tools to assist You. MYOB is not a financial advisor. The information, reports and content developed using the MYOB Advisor Technology are general information only and should not be taken as constituting professional advice from MYOB. You should exercise Your independent judgment and expertise in using, interpreting, adapting and communicating the content developed using the MYOB Advisor Technology.
  7. You must comply with any reasonable direction given by MYOB or its employees in relation to the MYOB Advisor Technology or the Trial.
  8. To the extent permitted by law (including the Australian Consumer Law), MYOB excludes all warranties (whether express or implied) not set out in these terms and limits any liability (whether arising under contract, tort or statute) for:
            (a) damage, loss or inability to use or access any data or programs caused by or arising (whether directly or indirectly) from the use of the MYOB Advisor Technology; or
            (b) any other loss, damage, cost (including without limitation consequential loss and loss of profits) or expenses arising (whether directly or indirectly) from the use of the MYOB Advisor Technology, if You fail to comply with any of these terms.
  9. To the extent that this licence to use the MYOB Advisor Technology is subject to implied warranties which cannot be excluded (e.g. under the Australian Consumer Law), the liability of MYOB for breach of any of those warranties is limited to re-instatement of the current release version (if any) of the MYOB Advisor Technology.
  10. You may at Your discretion choose to discontinue Your participation in the Trial by giving 24 hours’ notice in writing (by mail or email) to MYOB.
  11. The general terms and conditions governing Your use of MYOB’s products and services will continue to apply. This might include, for example, a Sales and Services Agreement and/or MYOB Accountants Office Live and Accountants Enterprise Live Terms of Use. In the case of any inconsistency between the terms, these terms shall prevail.
  12. If You agree with these terms, You may signify Your acceptance by email or by indicating acceptance of these terms through a web form.
