MYOB's Stick Santa Game Competition
TERMS AND CONDITIONS: GAME OF SKILL
1. HEADLINE DETAILS
1.1. Promotion entrants must:
1.1.1. be residents of: Australia;
1.1.2. minimum age: 18 years;
1.1.3. have an active MYOB software product or have previously purchased an MYOB software product;
1.2. Employees and contractors of the Promoter, and their immediate families, are not eligible for entry.
2.1. There will be fifty-two (52) winning entrant(s) (Winning Entrants) in total.
2.2. The Winning Entrants will receive:
2.2.1. a gift card valued at AUD 500, in the case of the Winning Entrant who records the highest score in the Stick Santa online game (Game);
2.2.2. a gift card valued at AUD 250, in the case of the Winning Entrant who records the second highest score in the Game; or
2.2.3. a gift card valued at AUD 100, in the case of the Winning Entrants who record the third to fifty-second highest scores in the Game.
2.3. The total value of the entire prize pool is AUD 5,750 for the combined value of all prizes. The prizes are not exchangeable and cannot be redeemed for cash from the Promoter.
2.4. Promoter has partnered with Edge Loyalty Systems Pty Ltd (Edge) for the provision of the prizes to the Winning Entrants. Within two (2) weeks of the Selection Date, Promoter will notify the Winning Entrants by email outlining instructions for how to redeem a prize. Winning Entrants will then have a two (2) month period from such notification to redeem a prize. To redeem a prize, the Winning Entrants may be required to create an account with Edge and agree to Edge’s Terms and Conditions (see https://www.edgepri.com/). If any prize is unavailable, Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value.
2.5. Any prizes that remain unclaimed after the two (2) month period with be forfeited.
3. PROMOTION ENTRY
3.1. By participating, the entrant agrees to be bound by these conditions.
3.2. The promotion starts at the time and date specified in condition 1.3. Entries must be received by the time and date specified in condition 1.4 (Promotion Period).
3.3. To enter the promotion, the entrant must, during the Promotion Period:
3.3.1. have received an email from Promoter inviting them to play the Game;
3.3.2. have played the Game;
3.3.3. have recorded a score greater than zero (0); and
3.3.4. have completed the entry form by entering their name and email contact details (using the same email address that the entrant received, and Promoter sent, the competition invitation to) and submitted the entry form.
3.4. By entering the promotion, the entrant consents to:
3.4.1. the collection use and disclosure of their personal information to Promoter, and any third-party assisting Promoter to provide the Game, solely for the purposes set out in these terms and conditions;
3.4.2. receipt of any communication regarding the promotion and other communication which informs the entrant of the Promoter’s products, services and events; and
3.4.3. the Promoter using the entrant's name, likeness, image, testimony or submission to the promotion in any media for an unlimited period without remuneration for the purpose of advertising and marketing this promotion (including any outcome), the Promoter’s products and services or the Promoter more generally.
3.5. All entries must be the original independent creation of the entrant, owned by the entrant and free of any claims, including copyright or trademark claims by other parties. Entries must not have been published previously or have won any awards or prizes in other competitions.
3.6. The Promoter reserves the right to:
3.6.1. verify the validity of entries and entrants;
3.6.2. disqualify any entrant who submits an entry that is not in accordance with these conditions;
3.6.3. disqualify any entrant submitting an entry which infringes a third party’s intellectual property rights, or in the Promoter’s opinion, includes objectionable content, including but not limited to profanity, potentially insulting, inflammatory or defamatory language.
3.7. Incomplete, indecipherable, or illegible entries will be deemed invalid. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
4. SELECTION OF WINNING ENTRANTS
4.1. The promotion is a game of skill. Chance plays no part in determining the Winning Entrants.
4.2. Multiple entries are permitted. Where an entrant has multiple entries, the entry associated with the entrant’s highest score alone will be used to determine if that entrant is a Winning Entrant. Prizes are limited to one per Winning Entrant.
4.3. Promoter will determine the Winning Entrants at 12pm on 7 January 2018 (Selection Date).
4.4. The Winning Entrants will be selected from the fifty-two (52) unique entrants (based on the email details provided) who meet the eligibility criteria and have recorded the highest scores in the Game. The Winning Entrants will each receive a prize as outlined in clause 2.2.
4.5. If any person first selected as a Winning Entrant is found to be ineligible under clause 3.6, they will be disqualified, and their prize will be distributed to the entrant with the next highest recorded score in the Game subject to these terms and conditions.
4.6. Promoter’s decision in relation to the Winning Entrants is final and no correspondence will be entered into.
5. WINNING ENTRANTS’ NOTIFICATION AND PUBLICATION
5.1. The Winning Entrants will be notified within two (2) weeks of the Selection Date via the email details entered by the Winning Entrant. All reasonable attempts will be made to contact the Winning Entrants.
5.2. The names of the Winning Entrants may be published using Promoter’s social media channels.
The Promoter is MYOB Australia Pty Ltd (MYOB), of Level 3, 235 Springvale Road, Glen Waverley, VIC 3150, Australia.
7. OTHER INFORMATION
7.2 If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, unforeseen legal or commercial circumstances or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify, delay or suspend the competition, or disqualify any entrant, as appropriate.
